Terms of service

These terms govern your use of Amaia. They are written to be read. If anything here conflicts with a signed agreement between us, the signed agreement wins.

The service

Amaia provides clinic management software: calendar, client records, forms, billing, messaging and AI-assisted marketing tools. Features may change as we improve the product.

Your responsibilities

• You keep your account credentials safe and decide who on your team has access.
• You are responsible for the messages and campaigns you approve, and for having the consent required by law to contact your clients, including written consent for text messages where the law requires it.
• You will not use the product for spam, to message people who asked to be removed from a list, or for anything unlawful.
• If you are subject to HIPAA, you will not enter protected health information into Amaia until we have both signed a Business Associate Agreement.
• You will defend and indemnify us against third-party claims that arise from the messages you send through Amaia, including claims under the Telephone Consumer Protection Act and similar state laws, from the content you enter, and from the care you give your patients.

Billing

• Prices are per location, per month, with the included users shown on the pricing page.
• Launch price. Clinics that subscribe by December 31, 2026 pay a base price of $599 per location per month, instead of the regular $800, for their first 12 months. After that, the price on the pricing page at that time applies, and we will tell you at least 30 days in advance.
• Setup is included. There is no minimum term. You can cancel at any time, and the service continues until the end of the month you paid for. Payment is monthly in advance, so a month already paid is not refunded.
• While you subscribe, you can export your data at any time. After you cancel, it stays available for export for at least 30 days. We delete it only after you confirm your export is complete, and then from our systems and backups within 90 days. Keeping patient records for the period your state requires is your responsibility.
• Third-party services. Amaia connects to outside providers that you choose and run in your own accounts, such as text and email providers, card processing, phone providers, advertising platforms, your own AI model if you choose to connect one, and any other service you connect. You pay those providers directly, at their rates and on their terms. Those costs are not part of the subscription, and Amaia is not a party to those agreements, takes no commission on them and is not responsible for their rates, availability or terms of service.

What we are not

Amaia is software, not medical, legal, financial or marketing advice. The AI features work only within the permissions you give them, and any action that sends a message, spends money or changes a record requires your approval. Final decisions about your clinic are always yours.

Liability

To the extent the law allows, our total liability for all claims related to the service together is limited to the subscription fees you actually paid us in the 3 months before the event, and in any event to no more than ILS 10,000.

The service is provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those in these terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Governing law

These terms are governed by the laws of the State of Israel. The competent courts of the Tel Aviv district have exclusive jurisdiction over any matter related to the service.

Who we are

Amaia is the trade name of the business. The party to these terms is Asaf Dotan, a business registered in Israel (Osek Murshe no. 200836609), Har Miron 2, Herzliya, Israel.
